This is an application under Section 438 of the Code of Criminal Procedure, 1973.
The petitioner is an accused in C.T. Case No.218 of 2015 on the file of learned J.M.F.C.
, Kantamal registered under Sections 341/323/294/ 354/506, I.P.C.
It is submitted on behalf of the petitioner that the dispute arose relating to borrowing
of some money and the allegation as has been made in the F.I.R. does not make out a prima fac
ie case under Section 354, I.P.C.
Considering the submissions and the circumstances, it is directed that the petitioner on
surrender before the learned J.M.F.C., Kantanal in C.T. Case No.218 of 2015 shall be released
on bail on such terms and conditions as deemed just and proper by the said court.
The Bail Application is accordingly disposed of.
Urgent certified copy of this order be granted on proper application.
