13.10.2015 Heard learned counsel for the petitioners, State and for the informant.
The petitioners are accused in G.R.Case No. 1044 of 2015 pending on the file o
f learned S.D.J.M., Kendrapara registered under Sections 294/323/341/307/34,I.P.C. read with
Section 25 of Arms Act.
It is submitted on behalf of the petitioners and placed before the Court that
as per the injury report obtained on behalf of the State, the victim has sustained some simple
injuries and as per the statement of the eye witnesses recorded by the Investigating Officer
, there was exchange of words and assault by means of fist and kick blows and nobody has sta
ted about the gun used by the accused.
It is submitted on behalf of the informant that the petitioners are repeatedly committ
ing such offences for which there are similar other cases pending against the petitioners.
Considering the submissions and circumstances, it is directed that the petiti
oners on surrender before the learned S.D.J.M., Kendrapara in the aforesaid case, shall be rel
eased on bail on executing bond of Rs.10,000/-( rupees ten thousand) each with one surety for
the like amount to the satisfaction of the said Court with the conditions that they shall app
ear before the Investigating Officer as and when required for the purpose of investigation and
shall not involve themselves in any act of the alleged type and any report of flouting any o
f the conditions, shall entail consideration for cancellation of bail.
The ABLAPL is accordingly disposed of.
