Mr. Amit Tyagi has made the present complaint dated 18.08.2025 to this Tribunal on Public Grievances Portal of this Tribunal, which has been treated and registered as Original Application No. 64/2026 (hereinafter referred to as the O.A.) for exercise of suo moto jurisdiction in view of law laid down by Hon’ble Supreme Court in Municipal Corporation of Greater Mumbai vs. Ankita Sinha, (2022) 13 SCC 401.

The Applicant has raised grievances regarding indiscriminate garbage dumping outside residential area of Gangan Enclave, Amrit Nagar, Ghaziabad, Uttar Pradesh (U.P.). The relevant part of the O.A. enumerating grievances of the applicant is reproduced as follows:-

“Subject: Urgent Complaint Regarding Uncontrolled Garbage Dumping outside the Residential colony Gagan Enclave, Amrit Nagar, Ghaziabad

Respected Madam/Sir,

I am writing this letter on behalf of the residents of Gagan Enclave, Ghaziabad, to bring to your kind attention the alarming and worsening issue of indiscriminate garbage dumping outside our residential area. Over the past several months, large quantities of garbage comprising household waste, plastic, construction debris, and even biomedical waste have been consistently dumped in open spaces around our colony. These dumping sites are not only an eyesore but have become a serious health hazard, leading to foul odours, water contamination, increased mosquito breeding, and the spread of diseases. Despite repeated complaints made to the local municipal authorities and the Ghaziabad Nagar Nigam, no effective action has been taken so far. The waste continues to pile up, posing a grave environmental threat and violating the residents' right to live in a clean and healthy environment, as enshrined under Article 21 of the Constitution of India.

The situation is in clear violation of the Solid Waste Management Rules, 2016, which mandate the scientific segregation, collection, and disposal of municipal solid waste. It also appears to be in breach of various directives issued by the Hon'ble Tribunal in similar matters concerning unregulated dumping of waste.

We, therefore, humbly request the Hon'ble Tribunal to:

1. Take suo moto cognizance of the ongoing environmental damage and health hazard in Gagan Enclave, Ghaziabad.

2. Direct the concerned municipal authorities and Uttar Pradesh Pollution Control Board to immediately investigate and resolve the issue.

3. Ensure proper waste segregation, collection, and disposal measures are implemented as per the Solid Waste Management Rules, 2016. 4. Impose penalties on violators found guilty of illegal dumping. We trust that the Hon'ble Tribunal will take this matter seriously and initiate urgent remedial steps to safeguard the environment and public health of our community.”

None has appeared for the Applicant today and the Applicant has not produced any material available with him in support of the averments made in the original application.

However, instead of dismissing the O.A. in default, we consider it appropriate to look into the averments made in the O.A. and take appropriate action.

We have gone through the original application.

The averments made in the application Prima facie raise substantial questions relating to environment arising out of the implementation of the enactments specified in Schedule-I to the National Green Tribunal Act, 2010.

In view of the facts and circumstances of the case, we consider it appropriate that a Joint Committee be constituted with direction to verify the factual position and to suggest appropriate remedial measures and to send copies of its report to the concerned authorities for taking appropriate action in accordance with environmental laws/norms applicable to the activity in question.

Accordingly, we constitute a Joint Committee comprising of representatives of Uttar Pradesh State Pollution Control Board (UPPCB) and District Magistrate, Ghaziabad and direct the same to meet within two weeks, undertake visits to the site, look into the grievances of the applicant, associate the applicant and representative of the concerned project proponent, verify the factual position and suggest appropriate remedial action by following due course of law and to submit its report within one month to this Tribunal and send a copy of the report to the concerned authorities who shall be bound to take appropriate action in accordance with directions given by Hon’ble Supreme Court and this Tribunal and particularly directions given by this Tribunal vide judgment dated 26.07.2024 passed in O.A. No. 613/2022, Ram Milan Sahni vs. State of U.P. and others and Principles of Natural Justice by giving opportunity of being heard to the concerned project proponent and to submit action taken report within next one month.

The District Magistrate, Ghaziabad will be the nodal agency for coordination and compliance regarding submission of the report of the Joint Committee and action taken reports by the concerned authorities.

Report by the Joint Committee and action taken reports by the concerned authorities may be filed as directed above before the learned Registrar General of this Tribunal, who shall be at liberty to place the matter before the Bench if further orders are considered to be necessary.

The District Magistrate, Ghaziabad is directed to ensure requisite compliance and submission of reports within specified period and in case of non-compliance, exemplary costs may be imposed by this Tribunal on the District Magistrate, Ghaziabad and concerned officers/authorities.

The present original application is disposed of accordingly.

However, in the eventuality of the applicant or concerned project proponent having any grievances against the report of the Joint Committee or action taken by the concerned authorities, the Applicant or the concerned project proponent may move this Tribunal by way of appropriate proceedings for such further orders as may be considered necessary.

A copy of this order be sent to the Member Secretary, UPPCB and the District Magistrate, Ghaziabad by email for requisite compliance.
