The applicant is present in person.

From the side of respondent Nos.5 to 7, learned counsel Mr. Kaushik Kulkarni has appeared and states that the matter is sub judice before the Hon’ble High Court of Bombay, Bench at Nagpur. Therefore, the amount towards Environmental Damage Compensation (EDC), which has been calculated by respondent No.2 – MPCB cannot be allowed to be realized/levied from respondent Nos.5 to 7. We do not agree with the submission of learned counsel for respondent Nos.5 to 7, particularly the

amount of EDC earlier calculated was for the period from 11.08.2023 to 20.06.2024 and this amount of Rs.24,53,125/- is the amount of EDC for

subsequent period against respondent No.7 – Shivaji Mangal Karyalaya and against respondent No. 5 – M/s Bhatrumandal, the additional amount of EDC is calculated at Rs.8,12,500/-. As regards respondent No. 6 – Lions Club Hall, it is stated by the learned counsel for respondent No.2 – MPCB and the applicant that the facility – respondent No. 6 has been closed down.

We dispose of this Misc. Application with a direction that respondent No.5 – Bhatrumandal, Malkapur and respondent No.7 – Shivaji Mangal Karyalaya, Malkapur shall deposit the amount of EDC of Rs.8,12,500/- and Rs.24,53,125/- respectively, with respondent No.2 – MPCB within one month from the date of uploading of this order, which shall be utilized by respondent No. 2 – MPCB for improvement of the area in question.
