The Miscellaneous Application No.13/2025 filed in Original Application No.19/2021/EZ is being taken up.

The Tribunal vide its order dated 25.04.2024 had disposed of the Miscellaneous Application No.13/2024/EZ (Ravi Shankar Mandal Vs. Union of India & Ors.) with the following directions:-

“5. We find that most of the directions of the Tribunal have been complied with, however, the Compliance Report itself mentions that; (a) PTZ camera are not installed at Phulo Jhano Chowk, (b) dust collection has not been installed at the Railway Siding in accordance with the directions given, (c) GI sheet with a height ranging from 20 to 25 feet, has not been installed between coal siding railway line no.05 and 06 to prevent dust and airborne particles from the siding area from entering into the passenger area, (d) 7 fog mist cannon are installed and functional in the north direction and 3 more fog mist cannon are to be installed in the same direction, (e) no water sprinklers have been installed on the side of stone chips siding to control the dust particles, (f) a pucca approach road has not been constructed in the wharf area and the space between railway line no.05 and 06 to mitigate the

dispersion of re-suspended dust and airborne particles, and (g) wheel washing and vehicle wetting facility has not been developed at the specified location.

6. From the Compliance Report we find that while several compliances have been made but the compliances enumerated in para 5 (a to g) have yet to be complied with as per own Report of the Committee.

7. We, therefore, dispose of the present M.A. with a direction to the State Respondents/Stakeholders to complete the remaining compliances as enumerated in the Report of the Joint Committee by 30.06.2024 thereafter the Committee shall re-visit the site in question and submit fresh Compliance Report before this Tribunal by 15.07.2024. ”

Affidavit dated 03.07.2025 has been filed on behalf of the Secretary, Forest Environment and Climate Change Department, Government of Jharkhand. Along with this affidavit, current Status Report of the Dumka Goods Shed of an inspection carried out on

15.05.2025 has been filed which reads as under:-

“Current compliance report of Dumka Goods shed, in terms of timeline given in the action plan prepared by the joint committee duly constituted by Hon’ble NGT, EZ Bench Kolkata in M.A. No.13/2024/EZ in O.A. No.19/2021/EZ in the matter of Ravi Shankar Mandal Vrs. Union of India and others.

In the light of the compliance of direction of meeting of minutes of joint committee held on 03/04/2024 in the office chamber of the principal secretary, Forest Environment & Climate Change Department, GOJ in compliance of the direction issued by the Hon’ble NGT, EZ Bench Kolkata in its order dated 18/03/2024 in M.A. No.13/2024/EZ in O.A. No.19/2021/EZ in the matter of Ravi Shankar Mandal Vrs. Union of India and others, Dumka Good shed was inspected on 15.05.2025 by the following officials:-

The construction of platforms for the fog mist cannons and the water line connections is also underway.

A perusal of the Inspection Report would show that PTZ cameras have been installed at Phulo Jhano Chowk. With regard to dust collection, the Committee has noted that the Assistant Commercial Manager-I, Eastern Railway, Asansol, has requested that installation of dust collector in an open space such as the Dumka Goods Shed to mitigate the coal dust is not feasible, however, PM10 analyzer has been installed at the railway siding to monitor PM10 levels with its online connectivity provided to the Jharkhand State Pollution Control Board server.

With regard to GI sheet with a height ranging from 20 to 25 feet not being installation between coal siding railway line No.5 and 6, the Committee has noted that GI sheet with a height ranging from 20 to 25 feet has been installed between the coal siding railway line No.5 and 6 to prevent dust and airborne particles from entering from the siding area into the passenger area.

The Committee has also noted that 14 fog mist cannons have been installed at the railway siding for effective dust suppression.

It is further noted that 5 mist fog cannons have been purchased and are currently in the process of being installed and construction of platforms for the fog mist cannons and water level connections is underway.

We, therefore, direct the Jharkhand State Pollution Control Board to ensure that construction of platform for fog mist cannons and water line collection are duly complied within the next two months i.e. by 15.09.2025 and the five fog mist cannons as stated above are duly installed.

As regards pucca approach road having not been constructed in the wharf area, the Committee has noted that a pucca approach

road has been constructed using concrete railway sleeper in the wharf area and the space between the railway line No.5 and 6 to mitigate the dispersion of re-suspended dust and airborne particles.

As regard wheel washing and vehicle wetting facility not being installed, the Committee has noted that the WBPDCL has developed a combined coal wetting and wheel washing facility in transportation route at Mouza-Hetkoria near Nakti Village before entering the populated area of Dumka town

In view of the Compliance Report referred to hereinabove, nothing further remains for adjudication in the present Miscellaneous Application except direction which have been given with regard to installation of five fog mist cannons by 15.09.2025.

The M.A. No.13/2025/EZ is accordingly disposed of.

I.As. if any, stand disposed of.

There shall be no order as to costs.
