This writ petition is filed for the following relief:

“To direct respondents 1 and 2 to promote the petitioner

as Havildar from 18.03.2010 and thereafter promote her as S.I.

¶28

of Police at the appropriate year with proper seniority with all attendant benefits without back wages within time frame.”

The petitioner joined the respondent department as Grade II Police

¶30

Constable in the year 1997. Thereafter, in the year 2000 she was promoted as Naik. The petitioner would submit that she was imposed with a punishment on the grounds of desertion. The petitioner submits that she underwent abortion on five occasions as a result of which she could not report for duty. The case of the petitioner is that the punishment of 3 years with cumulative effect was reduced to a 2 year postponement of increment without cumulative effect and the petitioner became eligible for inclusion in the list of Havildar from 18.03.2010. However, the respondents have

not taken in to account the same. Therefore, the petitioner made a detailed representation dated 28.03.2023 in this regard. Since there is no response the petitioner is before this Court for the aforesaid relief.

Considering the facts and circumstances of the case and the fact that the petitioner’s representation dated 28.03.2023 has not been considered to date, a direction is issued to the 1^st respondent to consider the petitioner’s representation and pass orders on merits and in accordance with law, within a period of 6 weeks from the date of receipt of a copy of this order.
