This Writ Petition has been filed for the following reliefs:-

“directing the respondent to pay the difference amount of terminal

benefits such as gratuity and earned leave salary, as per the 15th wage settlement along with 18 percentage per annum interest for the belated period of terminal benefits to the petitioner within stipulated time as may be fixed by this honble Court..”

The case of the petitioner is that, after rendering several years of service in the respondent Transport Corporation, he retired from service on 30.04.2024. The petitioner retired prior to the implementation of the 15th Wage Settlement entered into under Section 12(3) of the Industrial Disputes Act, 1947, dated 29.05.2025, which was given retrospective effect from 01.09.2023. As per the said settlement, the petitioner is entitled to differential amount of leave salary and gratuity. However, the said benefits have not been extended to the petitioner. In this regard, the petitioner had submitted a representation to the respondents dated 05.12.2025. Since the same was not considered, the present writ petition has been filed.

The learned Standing Counsel for the respondent would fairly submit

that they are willing to pay the applicable differential amount of leave salary

and gratuity in accordance with the 15^th Wage Settlement, together with interest at the rate of 6% per annum.

Heard the learned counsel for the petitioner and the learned Standing Counsel appearing on behalf of respondent.

In view of the above submission of the learned Standing Counsel appearing on behalf of respondent, this Court deems it appropriate to direct the respondent to pay the applicable differential amount of leave salary and gratuity to the petitioner, in accordance with the 15th Wage Settlement, together with interest at the rate of 6% per annum from the date on which the amounts became due till the date of actual payment. This payment shall be made within a

period of six weeks from the date of receipt of a copy of this order.
