The petitioner is apprehending his arrest in connection with Giridih Town P.S. Case No. 277 of 2025, registered for the offence under Sections 126(2), 329(3), 115(2), 109, 303 (2) 351(2), 352, 324 (4) read with 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the Court of learned Chief Judicial Magistrate, Giridih.

Learned counsel appearing for the petitioner through V.C. submits that there are general and omnibus allegations and the altercation took place due to certain dispute and both the sides have received injuries. He next submits that the petitioner side and informant side both are neighbours. He further submits that earlier also, one case has been lodged, however, later on same was compromised. He also submits that the injuries are said to be simple in nature. On these grounds, he submits that anticipatory bail may kindly be provided to the petitioner.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of making assault. On this ground, he submits that anticipatory bail may kindly be rejected.

Considering that both the sides are neighbours and due to certain dispute, the altercation took place and earlier one case was lodged, however later on said case has already been compromised and further injury is said to be simple in nature and in the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner, above named.

Accordingly, the petitioner, named above, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Giridih, in connection with Giridih Town P.S. Case No. 277 of 2025, subject to conditions as laid down under Section 482 (2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
