The petitioners are apprehending their arrest in connection with Balidih PS Case No.72 of 2026, for offence registered under section 303(2), 317(2) read with Section 3(5) of the BNS, 2023, and Section 21 of Mines and Minerals (Development and Regulation) Act, 1957, Rules 54 of Jharkhand Minor Mineral Concession Rules and Rul3 13 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in court of learned S.D.J.M., Bokaro.

Learned counsel for petitioners submits that the petitioners are owner cum drivers of different tractors and the allegations are made of carrying 100 cft sand each on the said tractors. He next submits that the petitioners are earning their livelihood by way of driving the said tractors and the sand in question was booked by

another person. He next submits that the petitioners have got no criminal antecedent as disclosed in paragraph no.10 of the petition.

Learned State counsel opposes prayer and submits that allegations are there of illegally carrying the said sand.

Considering that petitioners are owner cum drivers of different tractors and the petitioners are earning their livelihood by way of driving the said tractors and the sand in question was booked by another person and the petitioners have got no criminal antecedent as disclosed in paragraph no.10 of the petition, I am inclined to grant anticipatory bail to petitioners.

Accordingly, both the petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/(Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned S.D.J.M., Bokaro, in connection with Balidih PS Case No.72 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
