03/ 18.07.2026 Heard learned senior counsel for the petitioner and learned A.P.P for the State.

The petitioner is apprehending his arrest in connection with Dhanbad P.S. Case No. 1056 of 2012, registered for the offence under Sections 419, 420, 465, 467, 468, 471, 472, 473 and 474 of the Indian Penal Code, pending in the Court of learned Judicial Magistrate, 1st Class, Dhanbad.

Learned senior counsel appearing for the petitioner submits that the petitioner has been falsely implicated in this case and false allegations have been made against him. He next submits that the allegations against the petitioner is that of writing a letter dated 22.06.2010 to the District Transport Officer, Dhanbad enclosing therein a copy of proxy latter dated 18-19.06.2012 from the Ministry of Home Affairs, Government of India regarding the permission to install Red Light in his personal Maruti Ertiga vehicle. He next submits that these allegations are false and now the chargesheet has also been submitted and cognizance has been taken by the learned court. On these grounds, he submits that anticipatory bail may kindly be provided to the

petitioner.

Learned A.P.P. appearing for the State has opposed the prayer and submits that the petitioner is not appearing before the learned court in spite of the cognizance taken against him and due to that the matter is still pending. On this ground, he submits that anticipatory bail may kindly be rejected.

It transpires that serious allegations are there against the petitioner of forging the letter of Ministry of Home Affairs, Government of India. It also transpires that earlier this petitioner has also filed a petition for quashing of the FIR being Dhanbad P.S. Case No. 1056 of 2012 in Cr.M.P. No. 2462 of 2012 before this court, in which, the order was passed of not taking any coercive steps and pursuant to that A.B.P. No. 1199 of 2012 filed before the learned Sessions Judge was dismissed as withdrawn by the order dated 11.12.2012, as the interim order was operating in the said Cr.M.P. Later on the said Cr.M.P. was dismissed by the High Court on 30.11.2023 and further serious allegations are there of producing forged letter before the District Transport Officer, Dhanabd and even the Ministry of Home Affairs, Government of India has not been spared and further petitioner is not co-operating in the trial.

In the attending facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner, above named. Accordingly, his prayer for anticipatory bail is rejected.
