Heard Mr. R.S. Mazumdar, learned senior counsel for the petitioner and learned A.P.P. for the State.

The petitioner has moved for grant of bail in connection with Deoghar (Town) P.S. Case No.489 of 2025 registered for offence under Sections 331(4) & 305(a) of the Bharatiya Nyaya Sanhita, 2023, pending before the Court of learned Chief Judicial Magistrate, Deoghar. 3. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case only on the basis of suspicion. No incriminating article has been recovered from his conscious possession nor has he been put for T.I.P. and none of the witnesses examined during the investigation have identified the petitioner. The petitioner has no criminal antecedent and he is in custody since 18.01.2026. The petitioner undertakes to cooperate in the investigation/trial of the case and abide by all terms and conditions which may be imposed. Hence, the petitioner may be admitted to bail.

Learned A.P.P. has opposed the prayer for bail of the petitioner.

Considering the facts and circumstances of the case and nature of

allegation against the petitioner, I am inclined to release the above-

named petitioner, on bail. Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/(Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Deoghar, in connection with Deoghar (Town) P.S. Case No.489 of 2025.
