Heard Mr. Shashikant Jaiswal, learned counsel for the petitioner and learned A.P.P.

The petitioner has been made accused in connection with Balumath P.S. Case No. 80 of 2025 registered under sections 324(5), 326(f), 111(3), 111(4), 308(4), 308(5) and 61(2) of B.N.S. and Section 27 of Arms Act.

On 18.07.2025 at about 23:30 hours, the gang of Pradip Ganjhu and Rahul Dubey entered the premises of Magadh Coal Project and set the vehicles on fire in order to create terror to raise levy and fled away.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has committed no offence at all rather he has been falsely implicated in this case on the basis of confessional statement of the co-accused No persons.

incriminating materials have been recovered from the possession of the petitioner. The petitioner is languishing in judicial custody since 20.08.2025. Other co-accused, namely, Rakesh Kumar, Bablu

Kumar and Mukesh Kumar with similar allegation have already been granted bail by the Co-ordinate Bench of this Court in B.A. No.1120 of 2026, B.A. No.12024 of 2025 and 11283 of 2025 respectively. Petitioner undertakes to co-operate with the trial of the case and remain physically present on each and every date till the conclusion of the trial and shall not indulge in tampering with the prosecution evidence or influence the witnesses or gain over them. Hence the petitioner may be enlarged on bail.

Learned Addl. P.P. has opposed the prayer for bail of the petitioner.

On consideration of the fact that similarly situated co-accused persons have been granted bail as noted above, I am inclined to release the above named petitioner, on bail. Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Latehar in connection with Balumath P.S. Case No. 80 of 2025 with condition that petitioner shall appear physically on each and every date during the trial of case till its conclusion unless his physical appearance is dispensed with for sufficient cause to the satisfaction of the learned trial court and with further condition that petitioner shall not indulge in tampering with the prosecution evidence or influence the witnesses or gain over them.
