Heard learned counsel for the parties.

The petitioner named above has been made accused in connection with Gumla (Mahila) P.S. Case No. 27 of 2022 (Special POCSO Case No. 60 of 2022) for the offence under Sections 323, 376, 313, 354A, 498A, 494, 34 of the Indian Penal Code, Sections 3/ 4 of Dowry Prohibition Act and Section 4 of the POCSO Act.

It is submitted by learned counsel for the petitioner that the offence under Sections 376 and 354A of IPC will not be made out on the plain reading of the FIR as both are the legally married. The date of the alleged incident has not been mentioned but it has been stated that it took place four years ago.

Learned counsel for the State assisted by learned counsel for the informant, has opposed the prayer for bail.

Considering the facts and circumstances of the case, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each, to the satisfaction of learned Court below.
