Heard learned counsel for the petitioner and learned counsel for the State. The petitioner named above has been made accused in connection with Sariya P.S. Case No. 128 of 2022 for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 379, 385, 387, 120B of the Indian Penal Code.

It is submitted by learned counsel for the petitioner that about 15 persons have been arrayed in this case on general and omnibus allegation of assault arising out of land dispute.

Learned counsel for the State, assisted by learned counsel for the informant, has opposed the prayer for bail and submitted that in order to oust the informant from his settled possession, the petitioner has also assaulted the informant party regarding which Sariya P.S. Case No. 106 of 2022 was registered under Sections 341, 323, 379, 385, 504, 506, 34 of the Indian Penal Code on the written report of the informant. The highhandedness of the petitioner will be apparent from the fact that the accused had also assaulted the police party regarding which Sariya P.S. Case No. 127 of 2022 was registered under Sections 147, 148, 341, 323, 325, 307, 332, 353 of the Indian Penal Code.

Considering the criminal antecedent and the gravity of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is hereby rejected.

However, the trial Court is directed to expedite the trial and conclude the same as expeditiously as possible, preferably within six months after framing of charge. The petitioner will be at liberty to renew his prayer for bail after six months.
