1. Heard learned counsel for the applicant, learned A.P.P and learned counsel for the O.P. No.02.

2. Apprehending his arrest, the applicant has approached this Court for grant of privilege of anticipatory bail, in connection with Balidih P.S. Case No.85 of 2022, registered for the offence under Sections 323/ 341/ 354/ 366/ 406/ 423/ 468/ 34 of the I.P.C.

3. Innocence of the applicant has been claimed and undertaking has been given for co-operating with the investigating agency and participation in the trial. It has been submitted that the land, in question, has been sold by the mother of this applicant and this applicant has signed on the agreement paper as a witness. The mother of the applicant has been granted regular bail by this Court. The agent, who was involved in the transaction, has been granted bail on the ground that he has returned the money to the O.P. No.02. On the above basis, prayer for anticipatory bail has been made.

4. Learned A.P.P and learned counsel for the O.P. No.02 have opposed the prayer for anticipatory bail. It has been submitted that some money has also been received by this applicant and that money has not been returned.

5. Considering the nature of allegation and transaction between the parties, I am inclined to grant the privilege of anticipatory bail to the applicant. Accordingly, the applicant is directed to surrender in the court below within four weeks from today and in the event of his arrest or surrender, the court below shall enlarge the applicant on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bokaro in connection with Balidih P.S. Case No.85 of 2022, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further, this applicant will submit self-attested photocopy of his Aadhaar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
