03/05.01.2022 The present case is taken up through video conferencing.
The present writ petition has been filed with the following reliefs:
(i) For issuance of direction upon the respondent no. 3 to forthwith decide the Second Appeal filed by the petitioner under Right to Information Act, 2005 and to provide the information sought vide his application dated 11.08.2020 as well as to take necessary steps against the respondent no. 7 for not providing the information sought by him in terms with the provisions of the said Act.
(ii) For issuance of direction upon the concerned respondent to forthwith take necessary steps for regular functioning of Jharkhand State Information Commission by appointing the State Chief Information Commissioner as the Commission is defunct due to non-appointment of Chief Information Commissioner and other members since May, 2020.
Mr. Amritansh Vats, learned counsel for the petitioner, after some argument, prays for withdrawal of the present writ petition with liberty to the petitioner to pursue the concerned Second Appeal before the Jharkhand State Information Commission.
In view of the said prayer, the writ petition is dismissed as withdrawn with aforesaid liberty.
