Heard the learned counsel appearing for the respective parties. Defects, as pointed out by the office, are ignored.
The prayer for bail of the petitioner was earlier rejected in B.A. No. 7746 of 2021.
It appears that in course of trial P.W. 1, 2, 3 and 5 have been declared hostile by the prosecution. In fact the victim who has been examined as P.W. 6 as well as the informant who has been examined as P.W. 7 have also been declared hostile by the prosecution. The petitioner is in custody since 27.05.2020.
Regard being had to the above, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Rajmahal in connection with POCSO Case No. 23 of 2020 arising out of Rajmahal P.S. Case No. 206 of 2020 (G.R. Case No. 533 of 2020).
