The matter was taken up in National Lok Adalat in virtual mode.

Both the aforesaid Misc. Appeals have been preferred against the same impugned Award, as such, both are settled by a common award.

Heard, learned counsel for the claimants, Mr. M. B. Lal assisted by learned counsel, Mr. Rajiv Kumar Karn and Mr. G. C. Jha, learned counsel for the appellant/ respondent- The New India Assurance Company Ltd.

After a thorough discussion in between the parties, appellant/ respondent- The New India Assurance Company Ltd. has agreed to pay a lumpsum amount of Rs.6, 25,000/- in total to be paid to the claimants by way of final settlement. The Right of recovery granted by the learned Tribunal in favour of the Insurance Company shall remain intact.

Learned counsel for the claimants, Mr. M. B. Lal assisted by learned counsel, Mr. Rajiv Kumar Karn has accepted the proposal.

Considering the same, mediation in both the aforesaid Misc. Appeals is successful.

Accordingly, both the Misc. Appeals stand disposed of.

Appellant/ Respondent -Insurance Company is directed to satisfy lumpsum amount of Rs.6, 25,000/- in total by way of final settlement to the claimants within a period of 30 days from today. The Right of recovery granted by the learned Tribunal in favour of the Insurance Company shall remain intact.

The statutory amount deposited by Insurance Company before this Court at the time of the filing of the appeal shall be remitted/returned to the appellant- The New India Assurance Co. Ltd. by the learned Registrar General of this Court, within a period of four weeks from the date of filing of the requisition by the appellant- The New India Assurance Company Limited.

I.A. No.1017 of 2018 in M.A. No.38 of 2018 and I.A. No.681 of 2019 in M.A. No.717 of 2018 stand closed.

The parties are informed that the Court fee, if any, paid by any of them shall be refunded.
