The matter was taken up through Video Conferencing. Learned counsel for the petitioner had no objection with it and submitted that the audio and video qualities are good.
07/15.01.2021 Heard learned counsel for the petitioner.
It has been submitted by the learned counsel for the petitioner that the matter has been amicably settled between the parties in Lok Adalat and pursuant to that amount of Rs. 14,50,000/- has been paid as full and final settlement and that has been accepted by the claimant. Award of Lok Adalat has been annexed as Annexure-2 to the instant petition.
The case has come for the first time, however, as per the facts of the present case, no notices are required to be issued to the other side as claimant has received the entire amount and is satisfied with the same as recorded by the Lok Adalat.
In view of the above fact, the present CMP is allowed and the petitioner is permitted to withdraw the statutory amount deposited for filing M. A. No. 138 of 2017.
With the above observations and directions, the present CMP is, hereby, disposed of.
