The matter was taken up through Video Conferencing. Learned counsel for the parties had no objections with it and submitted that the audio and video qualities are good.

05/18.01.2021: The present application has been filed for grant of regular bail to the petitioner in connection with Taljhari P.S. Case No.44 of 2020, registered for the offence under Sections 20(B) and 22 of the NDPS Act, pending in the court of learned Principal Sessions Judge, Sahibganj.

Learned counsel for the petitioner has submitted that the petitioner is in custody since 14.06.2020. It has been submitted that similarly situated coaccused persons namely Md. Shahbaz Ali @ Md. Sahbaz Ali and Md. Banti @ Md. Faiyaz @ Md. Faiyaz @ Md. Banti have already been granted bail by the co-ordinate bench of this Court vide order dated 11.01.2021 passed in B.A. No.12131 of 2020 and the applicant stands on similar footing and as such he deserves bail.

Counsel for the State has opposed the prayer for bail and stated that the petitioner was the driver of ambulance meant for carrying covid patients.

Considering the period of custody and the fact that the co-accused persons have already been granted bail, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Principal Sessions Judge, Sahibganj in connection with Taljhari P.S. Case No.44 of 2020, subject to condition that the petitioner will submit self-attested photocopy of his Aadhar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
