03/18.01.2021: The present application has been filed for grant of regular bail to the petitioner in connection with Hariharganj P.S. Case No.24 of 2020, corresponding to G.R. Case No.989 of 2020, pending in the court of learned Judicial Magistrate First Class, Palamau at Daltonganj.
Learned counsel for the petitioner has submitted that the petitioner is in custody since 24.03.2020. Initially, the case has been lodged against four unknown persons. Subsequently, this petitioner has been arrested and confessional statement has been extracted. It has further been submitted that Rs.10,000/- and three mobile phones have been recovered. It has been further submitted that the mobile phones did not match with the mobile mentioned in the FIR and there is no criminal antecedent of this petitioner.
Counsel for the State has opposed the prayer for bail.
Regard being the facts of the case and considering the period of custody, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class, Palamau at Daltonganj in connection with Hariharganj P.S. Case No.24 of 2020, corresponding to G.R. Case No.989 of 2020, subject to condition that the petitioner will submit selfattested photocopy of his Aadhar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
