The matter was taken up through Video Conferencing. Learned counsels for the parties had no objection with it and submitted that the audio and video qualities are good.
03/07.01.2021 Heard learned counsel for the petitioner and learned counsel for the State. The petitioner is accused in connection with Noamundi P. S. Case No. 11 of 2019 corresponding to S. T. No. 197 of 2019 pending in the Court of learned Additional Sessions Judge- IV, Chaibasa.
It has been submitted by the learned counsel for the petitioner that petitioner is in custody since 09.04.2019. There is no specific allegation against this petitioner and as such, he deserves bail.
On the other hand, learned APP has opposed the prayer for bail and submitted that this petitioner is the main accused person, who instigated the crowd and he has criminal antecedent also. In that view of the matter, he does not deserve bail.
Perused the record. It appears that the petitioner has criminal antecedent and he is the main accused person, who has instigated the crowd. Therefore, this Court is not inclined to enlarge this petitioner on bail at this stage. Accordingly, the bail application is hereby rejected.
