The matter was taken up through Video Conferencing. Learned counsel for the parties had no objection with it and submitted that the audio and video qualities are good.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in connection with Daltonganj Town P. S. Case No. 306 of 2018 corresponding to G. R. No. 2038 of 2018 (S. T. No. 58 of 2020) pending in the Court of learned Sessions Judge, Palamau at Daltonganj.

It has been submitted by the learned counsel for the petitioner that the petitioner is in custody since 23.07.2019 and he has been named in the FIR due to enmity. There is specific allegation that Shubham Singh and Subham Giri called the deceased and thereafter hearing the gun shot, the informant has rushed there and informed that the deceased has sustained gun shot injury, due to which he died. Except confessional statement of the petitioner, there is no eye witnesses of the incident and further no recovery has been made to the confessional statement of this petitioner. Further similarly situated, two other accused persons namely Prince Singh @ Rahul Kumar Singh and Sunny Singh @ Raushan Kumar Singh have been granted anticipatory bail by the Coordinate Bench of this Court in A. B. A. No. 7853 of 2019 vide order dated 15.01.2020.

On the other hand, learned APP has opposed the prayer for bail and submitted that the petitioner has criminal antecedent and further he has accepted the guilt and as such, he does not deserve bail.

Perused the record. Although, the petitioner is named in the FIR, but there is no eye witness to the incident. Further the alleged confessional statement of the petitioner before the police has not laid to any recovery. Considering the material available on record, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Palamau at Daltonganj, in connection with Daltonganj Town P. S. Case No. 306 of 2018 corresponding to G. R. No. 2038 of 2018 (S. T. No. 58 of 2020) subject to the condition that petitioner will submit self attested copy of his Aadhar Card and also give his mobile number before the learned court below which he will not change during pendency of this case without prior permission of the court.
