Heard learned counsels appearing for the respective parties.

Defects, as pointed out by the office, are ignored.

The petitioners are accused in connection with Sudamdih P.S. Case No.84 of 2020.

It has been alleged that the parents of the informant were found murdered. Suspicion was cast upon the office bearers of Rainbow Multistate Credit Co-operative Society as they have misappropriated an amount of Rs.300 crores and in order to stop further inquiry through RTI, the murder was committed.

Learned counsel for the petitioners has submitted that one Dhiren Rawani was the office bearer of the Rainbow Multistate Credit Co-operative Society and all the three petitioners are related to Dhiren Rawani.

Learned counsel for the petitioners has further submitted that the father as well as the mother of the informant had lodged separate cases being Jorapokhar P.S. Case No.288/2014 & Jorapokhar P.S. Case No.400/2014 in which, final report have been submitted in favour of the petitioners. It has further been submitted that the mother of the informant had once again filed a case being Jorapokhar P.S. Case No.116/2015 in which also final report was submitted in favour of the petitioners.

Learned counsel for the petitioners has further submitted that cases have been registered by the petitioner No.1 as well as the brother of the petitioner No.1 against the deceased as well as the brother of the informant. Learned counsel for the petitioners has also submitted that so far as the allegation of defalcation by the office bearers of Rainbow Multistate Credit Co-operative Society is concerned, the C.B.I. had investigated the matter and submitted a final form showing the allegation to be false. It has therefore been stated that only on account of the previous enmity the petitioners have been implicated.

Learned A.P.P. has opposed the prayer for bail of the petitioners.

It appears from the allegation and the surrounding facts and circumstances of the case that both the sides were on inimical terms from before, as apart from the parents of the informant, the petitioner no.1 as well as his elder brother had also instituted cases against each other. It is to be noted herein that three cases instituted by the parents of the informant have been found to be false in course of investigation. The petitioners, therefore, seem to have been implicated only on account of suspicion due to the previous enmity which was existing between the parties.

Regard being had to the above, the petitioners, named above, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1^st Class, Dhanbad in connection with Sudamdih P.S. Case No.84 of 2020.
