The present application has been filed for grant of regular bail to the petitioner in connection with Tundi P.S. Case No.35 of 2020, for the offence under Sections 302/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner is in custody since 30.03.2020 and the investigation is already complete. The petitioner has been made an accused in this case on the basis of suspicion. No cause of death of the deceased has been ascertained in the post-mortem report. The FSL report also negates poisoning which has been suspected. It has further been submitted that the petitioner is ready to co-operate in the trial. On the basis of above facts, the prayer for bail has been made.

Counsel for the State has opposed the prayer for bail.

Considering the material available on record and the fact that the investigation is complete and no cause of death has been ascertained by the investigation team, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1^st Class, Dhanbad in connection with Tundi P.S. Case No.35 of 2020, subject to condition that the petitioner will submit self-attested photocopy of his Aadhar Card and also submit his mobile number before the learned court below which he will always keep active and will not change it during pendency of this case without prior permission of the court.
