02/15.01.2020 Heard Mr. Ritesh Kumar, learned counsel for the petitioner and Mr. P.D. Agrawal, learned Spl. P.P. for the State.

The petitioner is an accused in connection with Ghaghra P.S. Case No. 86/2018, corresponding to G.R. (Spt-II) Case No. 728/2018.

It has been alleged that the son of the informant was taken away by Sonu Oraon and others. The dead body of his son was subsequently recovered.

The petitioner seems to have been implicated on the confession of Sonu Oraon who has already been granted bail by this Court in B.A. No. 3061 of 2019. Several other co-accused persons namely Prashant Choubey @ Boby Choubey and Nitesh Jaiswal @ Nitesh Kumar Jaiswal @ Shivam Raj have also been granted bail by this Court in B.A. No. 7209 of 2019 and B.A. No. 9082 of 2019 respectively. It further appears that Mantu Khan @ Sheru Ansari had also confessed and named the petitioner. Therefore the petitioner appears to have been implicated merely on suspicion.

Regard being had to the above coupled with the fact that similarly situated co-accused persons have been granted bail, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Gumla in connection with Ghaghra P.S. Case No. 86/2018, corresponding to G.R. (Spt-II) Case No. 728/2018.
