02/15.01.2020 Heard Mr. Mahesh Tewari, learned counsel for the petitioner and Mr. Deepak Kumar, learned A.P.P. for the State.
Petitioner has been made accused in connection with Khunti (AHTU) P.S. Case No. 05 of 2019 corresponding to G. R. No. 275 of 2019 (S.T. No. 202 of 2019).
It has been alleged that the daughter of the informant and two others girls enticed away by the accused persons and taken to Delhi.
Learned counsel for the petitioner submits that there is vital contradiction in the Fardbeyan and in the statement of the victims recorded under Section 164 CrPC as in the Fardbeyan specific allegation has been levelled against one Manju Kumari @ Falguni Kumari who is said to have taken the girls to Delhi. It has further been stated that in the 164 CrPC statement, no overt act or any allegation of human trafficking has been alleged against the petitioner.
The petitioner appears to be in custody since 21.07.2019 and there indeed appears to be varied contradictions in the Fardbeyan as well as in the statement of the victims who had returned back.
Regard being had to the above, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned District & Additional Sessions Judge, 1st Khunti, in connection with Khunti (AHTU) P.S. Case No. 05 of 2019 corresponding to G. R. No. 275 of 2019 (S.T. No. 202 of 2019).
