Heard the learned counsel for the respective sides. The defect No. 9(iii), as pointed out by the office, is ignored. The petitioner apprehends his arrest in connection with Senha P.S.
Case No. 10 of 2018.
It has been alleged that the accused persons including the Ex Mukhiya had misappropriated the Government money.
The petitioner is not named in the F.I.R. In course of investigation it was detected that the amount was transferred in the joint account of Gram Panchayat Arru and the petitioner. The Ex Mukhiya Nisha Anita Oraon has been granted anticipatory bail by this Court in A.B.A. No. 4293 of 2019, subject to deposit of Rs. 75,866/-.
Mr. M. K. Roy, learned counsel for the petitioner submits that the said amount has already been deposited by her.
On such consideration, therefore, I am inclined to extend the privilege of anticipatory bail to the petitioner. The petitioner is accordingly directed to surrender before the learned court below within four weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Lohardaga in connection with Senha P.S. Case No. 10 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This application stands allowed.
