Heard Mr. Amarjeet Pd learned counsel for the petitioner and Mr.Amitabh learned counsel for the Respondents-Board.

In this writ petition the petitioner has prayed for direction upon the respondents to appoint the petitioner on compassionate ground.

The learned counsel for the petitioner submits that the petitioner's father died on 18.2. 2009 and pursuant to that, the petitioner filed an application for appointment on compassionate ground on 13.7.2009. He further submits that due to mistake, the date of death of the father of the petitioner has been wrongly mentioned as 18.2.1909 instead of 18.2.2009. The authority of the said department directed the petitioner to come forward with certain documents.

On the other hand, Mr. Amitabh learned counsel for the Board submits that there is a discrepancy in the date of birth in the matriculation certificate of the petitioner and as such the Central Compassionate Committee of the Board directed the petitioner to submit the documents, with regard to age and marital status and whether the brothers of the applicant is

under employment in Govt/ Non.Govt. Institution or not and affidavit signed and sworn before the Executive Magistrate, for taking responsibility of the dependent and other family members of the deceased and original Matriculation Certificate. In the counter affidavit it is admitted that so far as age and marital status and the brother employment and affidavit are concerned, the same have already been provided to the respondent-Board but so far as original matriculation certificate is concerned, that has not been provided to the Board and that is why the decision is still pending with the Respondent-Board to appoint the petitioner on compassionate ground.

On the other hand the learned counsel for the petitioner on the basis of the rejoinder to the counter affidavit filed by the Board submits that he had produced the documents annexed in the rejoinder and from those documents doubts are cleared. This matter is of the year 2012.

In the facts and circumstances as noticed above, this court directs the petitioner to file representation along with credential which have been filed along with rejoinder before the respondent-Board who will take a decision within eight weeks from the date of receipt/production of a copy of this order.

With the aforesaid observation this writ petition stands disposed of.
