Heard Mr. Rahul Kumar learned counsel for the petitioner and Mrs. Chandra Prabha S.C I for the State.

In this writ petition the petitioner has prayed for direction upon the respondents to issue interview letter for the purpose of selection to the post of Professor pursuant to the Advertisement dated 19.12.2010.

Mr. Rahul Kumar the learned counsel for the petitioner submits that the petitioner was appointed as Civil Assistant Surgeon on the recommendation of Bihar Public Service Commission in terms of notification contained in Memo No. 89(2) dated 20.6.1981.The petitioner completed his Doctor of Medicine(Paediatrics) and thereafter the petitioner was promoted as Assistant Professor,Department of Paediatrics in Jawahar Lal Nehru Medical College, Bhagalpur. On being promoted on 13.12.2003 on the post of Associate Professor ,the petitioner was posted as Associate Professor at Darbhanga Medical College and Hospital. Upon reorganization of the erstwhile State of Bihar the petitioner was allocated to the State of Jharkhand. On the basis of an advertisement which was published for appointment on the post of Professor and the petitioner has applied. He has not been considered for promotion on the post of professor. It is stated that representation has been filed and same is still pending

On the other hand, Mrs.Chandra Prabha S.C I submits that he petitioner was working as Ad-hoc basis and he has already retired and as such no fruitful purpose will be served if the

authority will be directed to pass an appropriate order as the representation is still pending with the respondents authorities. Accordingly, respondents authorities are directed to dispose of the representation by passing a speaking order as early as possible.

With the aforesaid observation this writ petition stands disposed of.
