3/24.09.2019 Heard Mr. N. K. Sahani, learned counsel appearing for the petitioner and Mr. Shiv Shankar Kumar, learned A.P.P. for the State.
The petitioner is an accused in connection with Chas(M) P.S. Case No. 20 of 2019 corresponding to G. R. No. 294 of 2019.
It has been alleged that the dead body of the nephew of the informant was found in the bushes. It has further been alleged that the mother of the deceased was having an affair with the petitioner which was resisted by the deceased. The mobile and wearing apparels of the deceased was recovered on 23.03.2019 at 2:10 P.M. and the confessional statement of the petitioner was recorded subsequently on 23.03.2019 at 2:50 P.M. Therefore, it cannot be stated that recovery was done pursuant to the confessional statement given by the petitioner. The petitioner is in custody since 24.03.2019.
Regard being had to the above, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/(Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge I, Bokaro in connection with S. T. No. 226 of 2019 arising out of Chas (M) P. S. Case No. 20 of 2019 corresponding to G. R. No. 294 of 2019.
