4/18.11.2019 Heard Mr. Ranjan Kumar Singh, learned counsel appearing for the petitioner and Mr. Moti Gope, learned A.P.P. for the State.
The petitioner is an accused in connection with Bank More (Bhuli) P.S. Case No. 52 of 2019 corresponding to G. R. No. 530 of 2019.
It has been alleged that the petitioner and his brother had enticed away the daughter of the informant for the purpose of marriage. The victim has been recovered and her statement under Section 164 Cr.P.C. was recorded in which she has stated that she was taken away to various places in unconscious state by administering medicine on her and the brother of the petitioner namely, Ajit Kumar had committed rape upon her.
Although, learned counsel for the petitioner has referred to a purported marriage agreement executed prior to the institution of FIR, but in view of statement under Section 164 Cr.P.C., the role of the petitioner is also apparent as he along with his brother was instrumental in abducting the daughter of the informant and taking her to various places.
In view of the nature of offence, I am not inclined to allow this application which is hereby rejected.
However, the learned trial court is directed to expedite the trial.
