Heard the learned counsel appearing for the petitioner and the learned APP appearing for the State.
Petitioner is an accused in connection with Gurabanda P.S. Case No. 16 of 2009 (G.R. No. 537 of 2009).
It has been alleged that on account of a blast the ante landmine vehicle was severely damaged. It has been alleged that there was indiscriminate firing by the extremists and one of the injured policeman has subsequently succumbed to his injuries. One of the co-accused, namely Ravi Gorai has already been acquitted by the learned trial court. The implication of the petitioner seems to be on the basis of the fact that the extremists were calling each other by name. The same is not comprehensible as there was mayhem and utter chaos on account of the landmine blast and in view of above, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ghatshila in connection with Gurabanda P.S. Case No. 16 of 2009 (G.R. No. 537 of 2009), subject to the condition that the petitioner shall remain physically present on each and every date before the learned trial Court till conclusion of trial.
