7/18.11.2019 Heard Mr. P. C. Sinha, learned counsel appearing for the petitioner and Mrs. Lily Sahay, learned A.P.P. for the State.
The petitioner is an accused in connection with Tisri P.S. Case No. 9 of 2004 corresponding to G. R. No. 415 of 2004.
It has been alleged that a raid was conducted by the police on an information that a meeting was being held by an extremist organization. Subsequently, there was an exchange of firing between the police personnel and the extremists and one of the extremists was found in an injured condition, who disclosed about the petitioner and others. One of the co-accused Jitan Marandi whose name has also come in the confession made by the Taslim Ansari has already been acquitted by the learned trial court. The petitioner appears to be in custody since 23.10.2018.
Regard being had to the fact that save and except confession of Taslim Ansari, there is no other materials which would indicate the complicity of the petitioner, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge III, Giridih in connection with S. T. No. 359 of 2018 arising out of Tisri P. S. Case No. 9 of 2004 corresponding to G. R. No. 415 of 2004.
