The petitioner has been made an accused for the offence registered under Sections 379, 411, 34 of the IPC.
Learned counsel for the petitioners has submitted that this is a case of misuse of bail of 3 years. That earlier petitioner was admitted on bail on 27.11.2015 and as the petitioner was not present physically before the learned court below hence, his bail bonds was cancelled and NBW was issued and now he is in custody since 27.11.2018.
In view of the facts and circumstances of the case, I am inclined to enlarge the petitioner on bail. Accordingly, petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five thousands) with two sureties of the like amount each to the satisfaction of the learned ACJM, Seraikella, in connection with Adityapur, R.I.T. P.S. case No. 85 of 2012, corresponding to G.R.No.326/2012(s) and subject to further conditions is that the petitioner shall deposit Rs.3,000/- by way of cost, before Secretary/ President Jharkhand High Court Advocates' Clerk Association latest by 21.02.2019 and to submit a receipt of the same before the court below at the time of furnishing bail bonds.
Let a copy of this order be sent to the court below and also to Secretary/ President Jharkhand High Court Advocates' Clerk Association.
