The petitioner has been made accused for the offence under Sections 414/34 of the Indian Penal Code and section section 30(ii) of Coal Mines Act and section 33 of the Forest Act.
Learned counsel for the petitioner has submitted that petitioner is innocent and has committed no offence as alleged in the FIR. Hence, petitioner deserves bail.
Learned APP has opposed the prayer for bail.
From perusal of the impugned order, it appears that 2.5 tones of illegal coal was recovered from the conscious possession of the petitioner.
Considering the submissions made by the learned counsel for the parties and also considering the period of detention, the petitioner, named above, is directed to be released, on bail, on furnishing bail bond of Rs. 25,000/- (Rupees twenty-five Thousand) with two sureties of like amount each to the satisfaction of SDJM, Ramgarh, in connection with Rajrappa P.S. Case No. 170/2018, subject to the condition that petitioner shall deposit Rs. 4,000/- in the court below on the date of furnishing his bail bonds, which shall be subject to the result of the case and will not prejudice the case of the petitioner.
