9/16.10.2019 Heard Mr. Ashok Kumar No. 2, learned counsel appearing for the petitioner and Mr. Rajesh Kumar Mahatha, learned A.P.P. for the State assisted by Mr. Navneet Prakash, learned counsel for the informant.
The petitioner is an accused in connection with Argora P.S. Case No. 313 of 2018 corresponding to G. R. No. 115 of 2019.
It has been alleged that the brother of the informant was kidnapped by the accused persons. The statement of Md. Jamil has been recorded under Section 164 of Cr.P.C. from which it appears that the abducted person was present in the Scorpio in which the petitioner along with other persons were present. In fact the presence of the petitioner along with the victim creates enough suspicion that the petitioner was also involved in kidnapping as well as subsequent murder of the deceased. On same set of allegations, the bail application of Amit Kumar @ Ram Pravesh Singh has been rejected by this Court in B. A. No. 3380 of 2019.
In view of the strong suspicion which has arisen in view of the statement of Md. Jamil, I am not inclined to grant bail to the petitioner and accordingly, this application stands rejected.
