04/22.04.2019 Heard Mr. J.N. Upadhyay, learned counsel for the petitioner and Mr. Rajesh Kr. Mishra, learned A.P.P. for the State.
The petitioner is an accused in connection with Bistupur P.S. Case No. 323 of 2017, corresponding to G.R. No. 2880 of 2017.
It has been alleged that Kamal Bhattacharjee had withdrawn Rs. 16,00,000/- as Housing Loan sanctioned in the name of the informant. The petitioner was one of the guarantors in the loan and a proceeding under SARFAESI Act was also instituted against the informant. In fact it appears that the loan amount which was to be credited in the account of the borrower was credited in the account of the guarantor. The petitioner is the wife of the main accused Kamal Bhattacharjee who is in custody since 24.11.2018.
Considering the period of custody undergone by the petitioner coupled with the fact that she being a lady, she is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate Jamshedpur (East Singhbhum) in connection with Bistupur P.S. Case No. 323 of 2017, corresponding to G.R. No. 2880 of 2017.
