4/22.04.2019 The Investigating Officer of Chatra Sadar P. S. Case No. 11 of 2018 is physically present. Pursuant to the order dated 15.04.2019, he has handed over the case diary to the learned A.P.P. It has been submitted that since there was some delay in the communication made on the side of the learned A.P.P., he could not comply with the said directions. Accordingly, the physical appearance of the Investigating Officer is dispensed with.

Heard Mr. Rajesh Kumar Singh, learned counsel appearing for the petitioner and Mr. Shiv Kumar Sharma, learned A.P.P. for the State.

The petitioner is an accused in connection with Chatra Sadar P.S. Case No. 11 of 2018 corresponding to G. R. No. 76 of 2018.

Suspicion was raised against Sarju Paswan and Muni Devi that they had enticed away the daughter of the informant to get her marriage solemnized with the petitioner. The victim on recovery has recorded her statement under Section 164 of Cr.P.C. from which it appears that she was in love affairs with the petitioner and she claimed that her marriage was solemnized with the petitioner at Delhi. The petitioner is in custody since 15.08.2018.

Considering the statement of victim recorded under Section 164 of Cr.P.C., the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction of Additional Sessions Judge III, Chatra in connection with POCSO Case No. 63 of 2018 arising out of Chatra Sadar P.S. Case No. 11 of 2018 corresponding to G. R. No. 76 of 2018.
