On 18.01.2018, a report was called for from the Assistant Sessions Judge, Rajmahal or his successor court, who was directed to obtain the report from Superintendent of Jail, Sahibganj as to whether the petitioner, Prabhat Thakur @ Kartik Pandit has been released from jail after serving the period of sentence imposed upon him and if released, when he has been released from custody.
The instant criminal revision is directed against the judgment dated 17.04.2002 passed by Sessions Judge, Sahibganj in Cr. Appeal No. 45 of 2000 confirming the judgment and order of conviction dated 18.11.2000 passed by the learned Assistant Sessions Judge, Rajmahal in Sessions Case No. 4/99 (G.R. No. 466/97), whereby and whereunder the petitioner was convicted under Sections 376/34 of the I.P.C. and was sentenced to undergo R.I. for seven years.
Report dated 02.05.2018 submitted by Sri Satyapal, learned Assistant Sessions Judge, Rajmahal reveals that petitioner namely Prabhat Thakur @ Kartik Pandit was in jail custody since 11.12.1997 and he was convicted on 18.11.2000 and after serving the sentence and also after getting the benefit of remission, he was released from jail custody on 14.08.2004. The aforesaid report is based upon the report received from the office of Sub-Jail, Rajmahal.
As the petitioner has already served the sentence imposed by the trial court, this criminal revision has become infructuous.
Accordingly, this criminal revision is dismissed as infructuous.
