Heard learned counsel for the petitioner and learned counsel for the State as well as learned counsel for the opposite parties.

The petitioner is apprehending his arrest in connection with the case registered under Sections 341, 342, 354, 506, 509, 511, 323 of the Indian Penal Code and Section 8 and 18 of the POCSO Act.

Pursuant to the order dated 20.02.2018 petitioner and O.P. Nos. 2 and 3 along with their counsel are remain physically present before this Court to explore the possibility of rehabilitation, it appears that petitioner is ready to pay Rs. 15,000/- to the O.P. No.2 by way of compensation. It further appears that father of the prosecutrix has stated that he does not want to pursue the case they reluctance to further proceed with the case.

In the fact and circumstances of the case, the above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-1-Cum-Special Judge, Latehar in connection with Balumath P.S. Case No. 130 of 2017 corresponding to POCSO Case No. 22 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, subject to the further condition that on the date of surrender petitioner will deposit Rs. 15,000/- before the learned Special Judge, Latehar by way of compensation, subject to the further condition that during course of trial petitioner not to threat or coerce the witness of O.P. No.2 and 3, if the petitioner indulge this type of activity prosecutrix-O.P. No.2 and 3 is at liberty to file an application for cancellation of bail of the petitioner.

After deposition of the aforesaid amount, the learned Special Judge shall issue notice to the prosecutrix and her father and after appearance of the O.P. Nos. 2 and 3, the learned Special Judge, shall release the aforesaid amount in favour of prosecutrix-O.P. No.3 after proper verification.
