In this Cr. M. P. the petitioner has prayed for extension of
time to surrender which was granted him vide order dated 16.11.2017 in A.B.A. No. 5501 of 2017.
Learned counsel for the petitioner submits that he could not appear because of unavoidable circumstances within the time fixed. He prays that the time of surrender may be extended for 10 days in terms of the order dated 16.11.2017 passed in A.B.A. No. 5501 of 2017.
After going through the records, I find that the petitioner was out of station as such he could not contact his lawyer. In view of the aforesaid submission, I allow this application. The petitioner, namely, Santosh Kumar Singh is directed to surrender before the trial Court in connection with Hariharganj, P.S. Case No. 22 of 2017 (G.R. No. 670 of 2017) within 10 days from today. The other conditions in the order passed in A.B.A. No. 5501 of 2017 vide order dated 16.11.2017 will remain as it is.
Thus, this Cr. M.P. stands allowed.
