4/15.02.2018 Heard learned counsel appearing for the petitioner and the learned counsel for the State, who opposes the prayer for bail.
The petitioner is an accused for allegedly committing offence punishable under Sections 387, 34, 120 (B) of the Indian Penal Code.
It is alleged that one Bijay Buxi was extorting the informant and was demanding money. To collect the said amount, this petitioner and two other persons reached the house of the informant where with the help of the villagers, they were caught. Admittedly, there is no transaction and this petitioner was arrested from the spot on 27.07.2017 and since then he is in custody. Further one of the co-accused, namely, Paduman Sahu has been granted bail by this Bench.
Keeping in view the period of custody, petitioner, namely, Krishna Badaik is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Gumla, in connection with Sisai, P.S. Case No. 81 of 2017, corresponding to G. R. No. 692 of 2017, subject to the condition that the petitioner shall appear before the Officer-in-Charge, Sisai Police Station (District Gumla) once in a month and shall mark his attendance. If he fails to appear in any particular month, his bail bonds shall stand cancelled and the Officer-in-Charge would be at liberty to arrest the petitioner.
