Learned A.P.P. appearing for the State opposes the prayer for grant of bail of the petitioner.
Petitioner is accused for allegedly committing the offence punishable under Sections 376, 419, 379, 323, 34 of the Indian Penal Code.
It is alleged in the FIR that the petitioner has committed rape upon the informant. After going through the record, I find that the informant was earlier married with one Md. Quadir. Informant, thereafter, left Md. Quadir and started residing with this petitioner. Thereafter the informant again left this petitioner and alleged that this petitioner has committed rape upon her. Learned counsel for the petitioner submits that the petitioner is in custody since 07.11.2017.
In view of the aforesaid allegation and also keeping in view the period of custody of the petitioner, I am inclined to grant privilege of bail to the petitioner. Accordingly, petitioner, namely, Riyaz Ansari @ Md. Riyaz Ansari, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Giridih in connection with Dhanwar Police Station Case No.140 of 2016 corresponding to G.R. No.1519 of 2016.
