2/22.02.2018 Heard learned counsel appearing for the petitioner and the learned counsel for the State, who opposes the prayer for bail.
The petitioner is an accused for allegedly committing offence punishable under Sections 364A, 302, 201, 120B/34 of the Indian Penal Code.
The son of the informant was taken by Sonu Kumar, Pappu Kumar Nonia and others. The son did not return. Lateron it was detected that the son of the informant was murdered.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR and his name transpired on the confessional statement of one Rana Indrajit. She further submits that similarly situated co-accused persons have already been granted bail by a Coordinate Bench of this Court and also by this Court and there is no eyewitness to the said occurrence.
Keeping in view the aforesaid fact, I am inclined to enlarge the petitioner on bail. Accordingly, petitioner namely, Raj Tilak is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. S.S.Sangita, J.M., Dhanbad, in connection with Saraidhela P.S. Case No. 71 of 2017 [G.R. No. 1733/2017].
