4/21.02.2018 Heard learned counsel appearing for the petitioner and the learned counsel for the State, who opposes the prayer for bail.
The petitioner is an accused for allegedly committing offence punishable under Sections 302, 120B and 34 of the Indian Penal Code, Section 27 of the Arms Act.
The father of the informant was shot by two persons. The informant is the eye witnesses to the occurrence. One of the co-accused Wakil Ansari's bail application has been rejected by the Bench of this Court on two times in B.A. No. 9509 of 2016 and 5750 of 2017, respectively, which is apparent from the impugned order.
Since the informant is the eye witnesses and one of the coaccused's bail was rejected by the Bench of this Court, I am not inclined to grant privilege of bail to the petitioner at this stage. Accordingly, the prayer for bail of the petitioner, namely, Mantu Sharma @ Matu Sharma, in connection with Paton, P.S. Case No. 37 of 2016, corresponding to G.R. No. 646 of 2016 (S.T. No. 168 of 2017), is hereby rejected.
This application stands dismissed.
The petitioner is at liberty to renew his prayer for bail after examination of the informant.
