Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with the case registered under Sections 414/34 of the Indian Penal Code, Section 30(ii) of the Coal Mines Act and Section 33 of the Indian Forest Act.

Learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case. It is also submitted that petitioner is the owner of a brick kiln running in the name and stype of M/s SWB Bricks” at village Sariya on the basis of valid documents.

Learned A.P.P has opposed the prayer for bail.

In the fact and circumstances of the case, the above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Ramgarh in connection with Ramgarh P.S. Case No. 413 of 2017 corresponding to G.R. No. 1408 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, and subject to the further condition that on the date of surrender petitioner shall deposit Rs. 6,000/- in the trial Court. However, the aforesaid deposition is subject to the result of the case.
