The petitioner is apprehending his arrest in connection with Complaint case no. 165/2017, the case registered under Sections 33,63 and 42 of the Indian Forest Act.
Learned counsel for the petitioner has submitted that petitioner is a permanent contractor of HINDALCO and he has been awarded the work of transportation of bauxite by the mining lessee M/s HINDALCO but he has been falsely implicated in this case. Hence, he deserves bail
Learned A.P.P opposed the prayer for bail.
In view of the arguments advanced by the learned counsel for the parties and also considering the fact and circumstances of the case and the nature of allegation alleged against the petitioner, the above named petitioner is directed to surrender in the Court below within Four weeks from the date of this order and in the event of his arrest or surrender, the Court below shall enlarge the above named petitioner, on bail, on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of SDJM, Lohardaga in connection with Complaint case no. 165/2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and subject to the further condition that petitioner shall deposit Rs. 10,000/- in the court below on or before his date of surrender,thereafter his bail bonds will be considered. The aforesaid deposit shall be subject to the result of the case.
