Petitioner is apprehending his arrest in connection with G(F) Case No. 525 of 2015 for the offence under section 33 of the Indian Forest Act.
It is alleged that on 15.12.2015 at about 3.00 hours in the day, a truck bearing Reg. No. 12B-4753 loaded with morum was seized.
Learned counsel for the petitioner has submitted that the petitioner has been implicated in this case only on the basis of suspicion. Nothing has been recovered from the possession of the petitioner. The petitioner is a student of B.Ed.
Learned A.P.P opposed the prayer for anticipatory bail.
In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand), with two sureties of the like amount each to the satisfaction of the Court of Miss Minakshi Mishra, learned J.M. Ist Class, Hazaribag in connection with G(F) Case No. 525 of 2015 , subject to the conditions as laid down under Section 438(2) of the Cr.P.C . The petitioner is directed to deposit Rs. 4,000/- before the trial court on the date of his surrender. It is made clear that aforesaid deposition of amount will be subject to result of the case and will not affect the case of the petitioner during trial.
