Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with the case registered under Sections 47(a) of the Excise Act.

Learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case. It is also submitted that petitioner is the registered owner of the alleged vehicle bearing registration No. BR09GA-2446 and he has no concern with the alleged seized foreign liquor.

Learned A.P.P has opposed the prayer for bail.

In the fact and circumstances of the case, the above named petitioner is directed to surrender in the Court below on or before 25.04.2018 and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Dhanbad in connection with Complaint Case No. 2685 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, and subject to the further condition that on the date of surrender petitioner shall deposit Rs. 25,000/- in the trial Court. The aforesaid deposition is subject to the result of the case and also on the following conditions:(i) One of the bailers shall be the local resident of Dhanbad district, solvent person.
